A holidaymaker who sprained his ankle after slipping near a swimming pool has been awarded £8,000 compensation.

The accident happened as he was walking from a swimming pool to the changing rooms at a popular leisure resort. He stepped in a drain gulley that was obscured beneath some plastic matting.

He damaged the ligaments to his right ankle and required extensive physiotherapy. He could not drive for two weeks and continued to find it uncomfortable to walk or drive long distances. His ankle still sometimes gives way underneath him without warning and he may eventually require surgery.

He took legal action against the holiday resort, claiming that it was negligent in breaching its duty to him as a visitor under the Occupiers’ Liability Act 1957.

The resort denied liability and argued that the gulley could be seen at the end of the mat so visitors should have been aware of the hazard. The two sides eventually agreed to an out-of-court settlement of £8,000. This was to compensate the man for his pain, suffering and loss of amenity.
