Insurance Claim as a result of a fire – BPS secured six figure settlement for Client

Betesh Partnership Litigation, acted under a “No Win, No Fee Agreement” acted on behalf of a Claimant partnership who suffered a substantial fire to one of the properties held in the partnership portfolio. The insurer sought to repudiate the policy on many grounds including allegations that the water supply had been turned off making the sprinkler system inoperable and thus entitling them to void the policy.

A highly regarded barrister worked closely with Betesh Partnership and discovered that the evidence supporting the disconnection of water was flawed and unreliable. The matter proceeded to trial to determine liability only. Betesh Partnership enjoyed trial triumph when at the end of the 5 day hearing Judgment was awarded in favour of the claimants.

Once it was determined that the insurance company would pay the parties engaged in formal mediation to achieve a successful 6 figure settlement for the partnership.
