Often parents learn that their ex-partner intends to move abroad taking their children with them. In our experience this has been a result of one parent wishing to move back to their home country or employment commitments. So what happens when parents live in different countries? Can you even stop your partner taking your child away? When do you get to see them?

The law suggests that both parents should consent to a child being taken to live abroad by one parent. If both parents have parental responsibility then written or oral consent must be obtained. In the event consent is not obtained in some circumstances should a parent take a child regardless this could be considered by the court as abduction.  If you do not agree to your child or children being taken abroad or you wish to take your children but your ex-partner does not agree then BPS are here to help you. We will discuss with you your parental responsibility and rights, abduction, the laws in the country in question. We will also advise you of your ability to make an application to court.
