  • Professional Negligence Success - Claim against Solicitors - 19/02/2010
  • Betesh Partnership Litigation acted under a "No Win, No Fee Agreement" on behalf of a Claimant residential home owner who was horrified to learn that two of his properties had been sold from under him without his knowledge or consent.

    Early applications for disclosure of the solicitor's sale conveyancing files suggested that the firm had been negligent in properly identifying the client as the registered proprietor.

    The matter was complicated because the person who sold the properties had produced a genuine driver's licence to the firm of solicitors and therefore we had to deal with the obvious allegation that the owner was involved in the transactions.

    Skilful investigations, mediation and presentation of evidence were key skills employed by Betesh Partnership in order to achieve an out of court 6 figure settlement.
  • Insurance Success - Claim against Insurer - 06/10/2009
  • Betesh Partnership Litigation acted under a "No Win, No Fee Agreement" on behalf of a Claimant residential home owner who suffered an escape of water at his second holiday home on the coast. The escape of water came from an upstairs water pipe near the bathroom and flooded the kitchen below causing extensive damage.


    To compound the problems the premises was later broken into and various valuable items were stolen. The insurer sought to repudiate the contract for various reasons which included an allegation that the property had not been occupied for a continuous period and therefore claims arising from escape of water and theft were excluded.

    The insurer also raised allegations of fraud in respect of damage to the kitchen which they maintained would cause the entirety of the claim to fail. Betesh Partnership was alive to the then recent changes in law which meant that a finding of fraud would no longer result in the genuine aspects of the claim to fail and a successful conclusion of the claim was reached in an out of court 5 figure settlement which also preserved the client's ability to obtain future insurance cover.
  • B.P.S instructed in test litigation - 05/05/2009
  • Betesh Partnership who currently receive instructions from one of the largest credit hire companies in the country and operate a dedicated litigation unit for credit hire claims against the Motor Insurers Bureau have been instructed to prosecute a number of cases through the Appeal Courts.

    Richard Wilcock who heads up the credit hire dept at B.P.S. states:-

    "We are seeking to establish a legal decision on recoverability of credit hire claims which, according to the MIB, are purportedly backed by insurance agreements. The MIB have, over a number of years, attempted to challenge the recoverability of damages under the uninsured drivers agreements by running numerous technical arguments at significant expense to the motor insurance industry and ultimately the policyholders. This challenge appears to be another one of those cases."
