BPS Win Five Figure Settlement for Client

Betesh Partnership Litigation acted under a “No Win, No Fee Agreement” on behalf of a Claimant residential home owner who suffered an escape of water at his second holiday home on the coast. The escape of water came from an upstairs water pipe near the bathroom and flooded the kitchen below causing extensive damage.

To compound the problems the premises was later broken into and various valuable items were stolen. The insurer sought to repudiate the contract for various reasons which included an allegation that the property had not been occupied for a continuous period and therefore claims arising from escape of water and theft were excluded.

The insurer also raised allegations of fraud in respect of damage to the kitchen which they maintained would cause the entirety of the claim to fail. Betesh Partnership was alive to the then recent changes in law which meant that a finding of fraud would no longer result in the genuine aspects of the claim to fail and a successful conclusion of the claim was reached in an out of court 5 figure settlement which also preserved the client’s ability to obtain future insurance cover.
